These Terms of Use govern your use of Rail the Way! (the "Game"). By playing the Game you agree to these Terms. If you do not agree, please do not play.
You must be at least 13 years old, or the higher minimum age required in your country, to use the Game. If you are a minor in your jurisdiction, you must have permission from a parent or legal guardian.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to play the Game for your own private, non-commercial entertainment. You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works from the Game, except to the extent this restriction is prohibited by applicable law.
Your progress is linked to your Telegram or store account. You agree not to: cheat, exploit bugs, use bots, automation, or modified clients; tamper with the Game, our servers, or other players' experience; attempt to gain unauthorised access; or use the Game for any unlawful purpose. We may suspend or terminate access, and reset or remove progress and Virtual Items, if we reasonably believe you have breached these Terms or acted fraudulently.
We provide the Game on an "as is" and "as available" basis. We may update, change, suspend, or discontinue the Game, or any part of it, at any time. We may also update these Terms; when we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the Game. Continued play after changes means you accept the updated Terms.
Our handling of your information is described in our Privacy Policy. You can request deletion of your account and data at any time through our Account and Data Deletion page.
To the maximum extent permitted by law, the Game is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Whale Played LTD and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, Virtual Items, profits, or goodwill, arising from or related to your use of the Game. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us for in-app purchases in the three months before the claim, or ten United States dollars. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Whale Played LTD from any claims, damages, and expenses arising from your breach of these Terms or your misuse of the Game, to the extent permitted by applicable law.
The Game runs on, and is distributed through, Telegram and Google Play. Your use of those platforms is also subject to their respective terms. These platforms are not parties to these Terms and are not responsible for the Game, except where their own policies provide otherwise.
These Terms are governed by the laws applicable at the registered seat of Whale Played LTD, without regard to its conflict-of-laws rules, and the competent courts of that jurisdiction will have authority over any dispute, unless mandatory consumer-protection law in your country of residence gives you the right to bring proceedings, or requires a different governing law, in your own country.
